These Terms of Service ("Terms") govern your access to and use of SwiftChat's website, dashboard, APIs and embeddable chat widget (the "Service"). By creating an account or using the Service you agree to these Terms.

1. The Service

SwiftChat provides an AI-powered support agent trained on content you supply, an embeddable chat widget, a management dashboard, analytics, lead capture and human handoff tooling. Features may vary by plan.

2. Accounts

• You must provide accurate registration information and keep your credentials confidential.
• You are responsible for all activity under your account.
• You must be at least 18 years old or the age of majority in your jurisdiction.

3. Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, deceptive or abusive purposes.
• Upload content you do not have the right to use, or that infringes third-party rights.
• Attempt to probe, disrupt, reverse engineer or overload the Service or its infrastructure.
• Use the Service to collect personal data from visitors without providing any legally required notice or consent.
• Resell or redistribute the Service except as expressly permitted.

4. Your Content

You retain ownership of the content you upload or crawl (documents, pages, Q&A material). You grant us a limited licence to process that content solely to operate the Service for you. AI-generated answers are produced from your content; you are responsible for reviewing their accuracy and for the content your assistant presents to visitors.

5. Subscriptions & Billing

• Paid plans are billed monthly or yearly in advance and renew automatically until cancelled.
• Prices are shown in EUR and may change with reasonable notice for new billing periods.
• You may cancel at any time; access continues until the end of the current billing period.
• Payments are processed by our payment provider under their terms.

6. Free Trial

Trial access, when offered, is for evaluation only. We may limit trial features, duration or usage at our discretion.

7. Intellectual Property

The Service, its software, design, branding and documentation are the property of SwiftChat and its licensors. Except for the limited right to use the Service under these Terms, no rights are granted. White-label options are available on eligible plans.

8. Third-Party Services

The Service integrates third-party providers (AI models, payment processing, push notifications, email). Your use of those features may be subject to the providers' own terms, and we are not responsible for third-party services.

9. Disclaimers

The Service is provided "as is" and "as available". AI-generated responses may be inaccurate or incomplete; the Service is not a substitute for professional advice. We disclaim all warranties to the fullest extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by law, SwiftChat shall not be liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill. Our aggregate liability is limited to the amounts you paid for the Service in the twelve months preceding the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, non-payment, or where required for security or legal reasons.

12. Changes

We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operating entity is established, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction.
